Terms of Business

Attention:

To ensure the safety and professionalism of our drone operations, we require thorough planning and preparation, as well as project information and necessary airspace checks before any drone flight takes place.

Airspace Restrictions:

Our drones are subject to the same rules and regulations as other air users, and some aerial filming may require further permissions from the CAA if it falls into restricted airspace. The CAA advises 28 days’ notice for any such requests, and while we will endeavour to obtain approval for our clients, we cannot be held liable if the approval process takes less than 28 days.

Final Decision:

The Pilot in Command may decide not to proceed with the drone flight if they believe it may pose a risk of injury to persons or property or if client demands are unreasonable. We will work with you to achieve your goals in a safe manner.

Flight Planning and Locations:

We will calculate the amount of filming required for each project and confirm and agree upon multi-site flights. Any additional sites not previously agreed upon will incur additional charges. If we are not informed of all the sites during the initial planning phase, we cannot guarantee we will have enough batteries.

Image and Video Rights:

All footage we collect is for the client’s exclusive use and is non-transferrable. We reserve the right to use the footage for marketing, promotion, and stock footage purposes. However, clients may refuse to allow their media to be used for marketing or stock footage, but must put their refusal in writing prior to filming or photographing.

Limits:

We will not fly above 120m (Above Ground Level) or beyond a 500m radius of the drone Pilot without CAA authorization. Clients requesting altitudes or distances exceeding these limits must allow 28 days for CAA approval.

Operations Manual:

Our Commercial Operational Authorization follows our Operations Manual, and we cannot legally work against its provisions. The pilot will inform the client if anything may breach these rules.

Payment:

All payment terms are set at 14 days from invoicing, full payment must be made before final image and/or video files are released. Late payments will incur a charge of 10% of the total invoice per calendar month. All prices quoted on our website are excluding VAT.

Quotes:

Our quotations and financial commitments are based on the accuracy and validity of the information provided by the client. We maintain the right to renegotiate any contract, cost agreement, or other commitment should the information provided by the client be found to be inaccurate or incorrect.

Travel:

All travel to sites beyond 20 miles of our Livingston office, will be charged at 50p per mile.

Weather:

We cannot be held responsible for sudden weather changes. We recommend clients choose at least two aerial filming dates a week apart to ensure optimal weather conditions for their project.
